They didn't share any details on the divorce settlement and if there were any provisions pertaining to the lease, so I don't know if there are any details on that front that matter.

Getting a credit will reduce your cash outlay at settlement. 

In your foreclosure scenario did the title company contact the HOA and get a statement ... so that the HOA dues, etc. could be adjusted as of the settlement date?

Most likely due to soil moving or settlement.

Get it done and give the receipt to the closing attorney to add to the settlement statement as a charge to the buyer to be included in the closing costs.

That's especially true since a lot of settlement agents do not know how to deal with slight variances during the foreclosure process.

I will tell you that the very best thing you could do, as others have said, is to wait until your divorce is final and you have your settlement finished.
