It would be a rarity for a DA to spend their limited resources going after a person whose inaction caused harm - especially so when inaction is the standard procedure for the issue.

They are looking from the inside out at exposure to trees, ADA, trip and fall, wind storm, hail, lighting, bed bugs, dog bites, eviction....so the cost to eliminate the exposure for the product you are selling is maybe small to you, but to them there are a dozen similar concerns.
