I also mailed him $250 as a sign of good faith because as frustrated as I am with him and as much as this is the last thing I wanted to do, I realize this whole mess could have been avoided if it wasn't for my own shortcomings regarding the lease - and if I am going to continue to rent the house with clear guidelines for parking in the lease, then I would like to remain on good terms with him to avoid more problems in the future (as much as possible, anyway).So now I'm going to dig into the survey and my deed to see what rights I have regarding the driveway and let things cool down for a bit.

You should talk to a local attorney if you have any interest in seeking damages for your losses in this deal.Generally speaking, fraud requires the defrauder to have had the intent to defraud the person -- which can be difficult to prove without any specific evidence of bad faith.
