@Nadir M. tenant is responsible but realistically if a wasp nest is attached to the house I remove it. 

Thankfully she bought like that and did not have an emotional attachment. 

Bottom line is it's a pain in the butt and in some areas you have to escrow money for those items (see the escrow column in attachment below).  

And if you win that auction, there is still a primary lien attached to the property and the old owner.

Each state has different laws with respect to what a creditor can attach to.
