Another cliche is the best way to triumph in a lawsuit is to avoid it in the first place.What I am more concerned about are frivolous lawsuits, such as a tenant blaming his emphysema on some non-existant mold at my property and not the 3 packs of cigarettes he smokes daily.

No cigarette in hand, because as soon as he sees my screen door open, he stubs out his cig.When they (the smoker guy and his girlfriend) signed the lease, I reiterated to them very strongly that there is no smoking allowed anywhere on the premises, and they initialed that page of the lease that includes the no smoking clause, in italics.

Very few places do and you could probably charge a premium and reduce turnover plus when someone leaves it’s not like you have to completely renovate it if you get another smoker.
