I would prefer a bank like BofA or Wells where I can place a claim and get my funds back should something go awry. 6) He did provide me a Proof of Funds statement from California Trust Bank which did show a lot of large deposits, wire transfers, and transactions however I am proficient enough in Photoshop to know that this is a document that one can easily create with the proper software.

You can form a new entity, you being the manager and the money partners being limited partners with shares based on their investment amounts or you can each be on title as tenants in common (I don't recommend if more than 1 money partner).I am not a CPA or attorney so none of this should be construed as legal advice but I am very proficient at setting up private money lender deals as that is how I have funded almost all of my deals in my 15+ years.Speak with your RE attorney, he or she can help you with these items.
