If they have an unlawful detainer judgement against them, even if they left before the sheriff came that is an eviction.

I think in Oregon material men have 75 days post CO to file a legit claim.. after that its unlawful and they have to sue for unjust enrichment claim.

I've been told by my attorney that we can't even file the unlawful detainer yet and I think it's likely that the Newsome is going to extend the moratorium again.

I believe as of now pre covid evictions have been frozen and current unlawful detainer paperwork isint being accepted by the California courts from what I’ve been told by neighbors/friends and local investors.

For example, there are ways to look up a person and find out if they’re party to an unlawful detainer action (eviction), or look up a property and find out if there are any past due property taxes or code enforcement liens.

You will likely have to go through the standard eviction/unlawful detainer process in your jurisdiction.Please note that the CARES Act has not prohibited eviction on the basis of anything other than nonpayment of rent, however, your local jurisdiction may have put a hold on evictions.
