IE lets say you fight this for the next year, get a judgement for $100k in damages, but if he/the llc doesn't have $100k in assets, good luck collecting - people can't pay you what they don't have.

As an example if you are doing a 5% down loan on a 100K house, it wouldn't make sense to go to the extra effort to have it in an LLC, I mean what would a judgement against you cost?
