I noticed in Governor Ever's Emergency Order this provision "However, if the tenant is holding over on the property, in violation of Wisconsin Statute § 704.25, the Emergency Order does not bar a landlord’s right to seek relief against the hold-over tenant."

@Fabian Wizenfeld Hi Fabian, the State’s Judicial Council adopted emergency rules a couple of weeks ago that state that courts won’t hear unlawful detainer or foreclosure actions until 90 days after the Governor’ State if Emergency is lifted.

Our NJ governor has just declared via Royal Fiat that any tenant - any - whether adversely affected or not- can use their security deposit to pay rent, either whole or part.We can still sue in civil court for damages though!

That being said, until we have a clear understanding of what the governor's plans are regarding eviction moratoriums and "reopening" phases, I recommend treading water.

The governor announced by proclamation on June 2, 2020 he was extending the eviction moratorium until August 1 with some amendments as follows: In addition to situations where an imminent threat to health and safety exists, landlords can evict for:Property damage if it is urgent and unknown to the landlord prior to COVID-19.Intent to occupy and/or intent to sell with 60 days' advance notice.
