I recommend you check with competent Texas consul for advice or ask the settlement agent for a commitment which should have a requirement for a deed from whomever the underwriter will rely on for the conveyance together with whatever other requirements they will need met before insuring your interest in the property.

The lawyer was clearly hoping for a quick and easy insurance settlement and didn't want to put actual time and effort in an ambulance chasing case.
