At the very least, a sale that violated that covenant would cloud title insurance to the extent of that amount, it will not prevent the property from being sold and closed.

Even if you do get close to closing, you'll have a clouded title and it probably won't close until the issue is cleared up.

I don't see any defective deed, not at this time, the deed was never effected as nothing was ever filed to cloud title, A still owns it.

A lease is a cloud on title, a restriction to title by providing tenants rights to the use of the property but not to title.In most states I believe an option will cloud title as a restriction to the ability to convey good title (all states that allow options) but the degree of equity interest conveyed will be different.
