Given that he's got a long history in business but is struggling to cover $30k in Op-ex and marketing spend, my guess is that this is either not very well managed or is in distress.

My lease states that I can file a landlord tenant complaint without providing notice to quit - if the tenant vacated the property but left me with a squatter (ex boyfriend) that won't leave the unit - would the clause i have in the lease still follow along the same lines for this squatter?

Not allocating cap ex and maintenance because an item is not expected to fail soon is simply providing a misleading return estimate.  10% maintenance/cap ex ($132) is less than half of reality and maybe less than 1/3 of reality.  

This is an area of a lot of ex-pats and longtime vacation takers, or people that have rentals there.

triple net (nnn) lease is a typically commercial lease where tenant is responsible for all maintenance/cap ex and usually tax and insurance.
