If you are audited, and they find large discrepancies, the Tenant will expect answers and an immediate credit, and in some circumstances make the Landlord pay for the audit.

The seller has accepted my letter of intent, and this initial due diligence phase has uncovered some discrepancies.  

The property is listed at $549,900 and it has been on the market for 1,176 days--it is also a foreclosure.The assessed value from the auditor's site is $290,000.Why the BIG discrepancy?

I am not a lawyer, and this is not legal advice, but because of the square footage discrepancy, you should be able to get your deposit back.  

A good rule of thumb is that if there is any discrepancy between a written document that you have signed and someone's verbal representation the signed, written document will rule.

There is some fancy financing to cover the difference, seller financed over 12 months half the discrepancy and I brought cash to the table for the other half and had included in the closing docs/cost.
