I have gotten many judgements from my borrowers in those states, Not that they were worth anything but they last for 10 years and I know who they are and I have an Accurant account so I can find them 7 to 9 years down the line when they have forgotten about me !!!

I've found that by laying out our tenant profile which gives our basic criteria, it's not that common that we have to make a judgement call on a single issue.

And of course investment loans were subject to default judgements.. but again so much was going on most folks were able to walk, Although I know some investors who ended up getting sued on their notes and had to go BK to remove it.

That is the best way to figure out what your property will sell for, the only problem is, no two houses are exactly alike, so you have to use your judgement to adjust yours.

As a PM, I have been sued by tenants for violations of the Florida Consumer Collection Practices Act for trying to collect unpaid rent (bogus lawsuit, tenant is the one who ended up with a judgement, but still cost me $10k in legal fees).

That they can either (a) move out immediately voluntarily, (b) I can give THEM an 30 day LOAN at $___ for the remainder of rents or (c) I will have to file eviction paperwork and suite for judgement against all 3.

Big picture, it's possible in certain instances that you could make money on those seconds, but it will be a long haul, require up front investments in law suits against the borrowers, and require those borrowers to recover enough from their foreclosure to have sufficient assets to actually pay you within the time allowed to collect on your judgement.
