I plan on declaring the rental income.

I checked and the wife wrote the initial money order for it so I plan to make it entirely out to her.I have seen it declared in the lease who it will be returned to.

The rental income is actually with leases and will be declared on my tax return so that may be why they are willing to consider it, however you raise a good point.  

Maryland had a court of appeals ruling that that declared pit bulls and pit mixes “inherently dangerous” and imposed strict liability on owners and landlords.

If you do move in, no harm no foul, but if you don't and there is an investigation you pretty much shot yourself in the foot by indirectly declaring your intention in your question.

The declarations are vary vague about landscape requirements "lawns will be maintained to the standard of the community."  

Technically their insurance does you little good unless they get a declaration (or whatever the agents call it) from their agent specifying your property address and you/your company.  

If you are opening the LoC shortly before - or in tandem with - your mortgage it may not register on your credit history before the mortgage is awarded ... though these days such things are automated and near real-time, so there will probably be very little lag.Regardless, when you read the fine print of your financing application and/or the mortgage documents themselves there will undoubtedly be included a declaration where you attest the downpayment does not comprise borrowed funds.
