Sorry for the lengthy reply but I thought sharing my story may give you a more broad outlook of an individual occurrence.

Wait till after the proceeding, file it with the DA, because statutes on financial fruad are lengthy, and then also file it with Checks system.That way, it follows them after the fact, instead of during the process.personally, Im a blood thirsty bastard, and if you are gonna make me bleed, I want you to feel the blows in kind long after I am a lingering memory in your mind.

Rent was overdue on 4/5 according to the lease in place.

I will not go into that at this point but would be smart to talk to a real estate attorney and understand how you need to structure these type of deals.Sorry for the lengthy response. 

So, if rent is overdue, give him a notice to pay rent or quit, or whatever notice is used where the property is located.Do they have his name?  

Under Minnesota law, a late fee policy must be agreed to in writing, and may not exceed 8% of the overdue rent payment.
