There should be a paper trail and just maybe you wrote a check and put "security deposit" on the memo line....

Other strategies including using land trusts.Your CPA may not be a big fan of these strategies, as the paper trail may become complex, but for those with experience dealing with investors, it likely won't be a big issue.  

And a debit card with one month's rent.No paper trail, and this is not advertised.If you are going to give, give!

When following the paper trail it seems if I won the bid at auction I would be first lien holder which would wipe out the 2nd lien. 

You will have a much better paper trail for the exchange if you actually put renters in and then evaluate.  

I've seen a 1st lien get approved as a loan modification but the junior lien not provide a subordinate agreement; therefore the 1st would not implement the final modification even after the trail plan payments were made.
