Presumably, the current lease agreement states the tenant is responsible for any loss if they breach the contract which includes abandonment and voluntary surrender.   

It's his choice to either surrender the key or pay for re-keying.

Move-out at different times and there's issues.Change lease:The security deposit is held until the unit is totally vacant and the keys are surrendered. 

Another honorable mention in predatory practices is using CFD/LC to have a borrower with a conventional mortgage or deed of trust surrender their property and enter into this type of contract as loss mitigation strategy on a delinquent or defaulted loan - I would just stay away from that all together.That is not to say they are ALL bad but our stance is they seem to often be abused and the abuse so far has not been reigned in but it is coming.  

Keep in mind that a mobile home that is not permanently attached to the ground with the axles removed has a title like a car rather than a deed like real property - it is not real estate until it is "permanently" attached to the ground and the title is surrendered. 

You should do the move-out within two weeks of their surrender of the keys to allow them to address the issue.I take pics at both events, they get none.Given the check list itemizations, I've never had a suit filed.

You are welcome to move sooner and I will refund the balance of October rent along with the security deposit when you surrender the keys as long as there is not any damage to the property.

In her last message she stated she would probably leave in late November but was happy to pay the December rent as owed (again, she did pre-pay this).Technically, she has neither Abandoned (because she paid her rent) nor Surrendered (because she provided no definitive written notice specifying her date of Surrender) under the contract.First question... 

She is surrendering the keys to me tomorrow and also signing a form stating she and he are surrendering the apartment .

It might be acceptable to surrender some long-term equity for stronger returns, the same way you might buy a flat stock because the dividend is spectacular.
