Also - a memo is 99% of the time not filed correctly - so if the seller had anyone legal helping them when it pops up they could get out of it.Tell the wholesaler to send a recorded copy of the memo to the seller and tell them title is now clouded.

Their argument is we received notice from our title search in March 2022 there was a cloud on the title.

They were an OK tenant, and I rented to them since their son lived in the property as well but, these items should not cloud your judgment when making a decision.

We poured a floor a week on a 38-story building and EVERY week, the prime rate went up a point and stopped somewhere around 19%...so much for griping about today's rates.The market we were playing to was the new "empty nesters" that were emerging and wanting to sell their homes on Lake Washington or the gold course and move into downtown hi-rise living in a then gentrifying city.The only thing that allowed the project and me to survive was my "bodyguard" money partner, a Canadian bank that gave us the ability to hold ~130 units until the rates came down from the clouds and some form of rate sanity returned.

They will have pulled an abstract report of title to review and they will issue any exclusions to coverage if there are any or they will identify items clouding title which need to be cleared to be insured.

I will be getting a Special Warranty deed.1) Am I correct in understanding that if I get the proper title insurance (extended) to cover unrecorded leins and the like, my interest will be protected from clouds in the title that occurred prior to bank's foreclosure on the property?

In other words, in this scenario, a (subsequent) Quit Claim Deed will not have any way of clouding the Title, right?
