Also, a buy sell agreement is handy to  be executed upon certain events, cash out the departing member, this too goes to the operating agreement.As to operating agreements, you only do one and keep it, you can change or amend it as needed, but you do need one adopted.

If you do choose to pursue the deal, consult your real estate agent and ask them to write up an Amend/Extend Agreement, extending closing date until after the eviction has been cleared up.

I do have an accountant but she (or her team) made a mistake last year and we had to file an amendment so part of my refund got delayed, also I'm not sure if I need an accountant specializing in real estate or if any one would do. just fine.

That can be a mix up by the loan officer or it is possible, though not overly likely, that the lender has amended the guideline to fit what you were told.
