Though I hate to do it in case there are damages, think you can have tenant sign a letter (run it past an atty first) surrendering sec dep as last months rent.

The law is pretty clear that they have to surrender the premises first.From your state's landlord tenant act:"the landlord shall refund a security deposit to the tenant on or before the 30th day after the date the tenant surrenders the premises.However, Section 92.107 provides an exception to this:The landlord is not obligated to return a tenant's security deposit or give the tenant a written description of damages and charges until the tenant gives the landlord a written statement of the tenant's forwarding address for the purpose of refunding the security deposit."

Borrower can choose to surrender the property in the chapter 13 plan, or they can treat it to bring/keep mortgage current (they could also try to do a cram down, or strip liens from the property, there are a number of factors that play into whether they can do these things).
