The property is in a nice touristic area 40 miles from the border and a Mecca for surfing as the waves are very small and perfect for beginners and intermediate surfers.

As for the leak you have the right to repair your home so you can simply say the plumber will be here at 2pm tomorrow and you can let the plumber in. normally  the tenet has the right to live in peace meaning that you can't just come over whenever you want but that right is waved when you need to repair your property.

I talked to the delinquent tenant waving a crisp $100 bill in his face stating the money is his if he moves out today, signs an agreement surrenduring the apartment giving the key back.

Mine made VERY good money and I managed to ride the first wave of regulations but the haters didn't stop and the moratorium on licensing left me with two choices, to hold as long-term rentals or sell.

If your concern is just about the future demand and prices, I would recommend that you hold tight and ride the wave.

I have all the necessary letters, documents photos etc that show they are responsible for the total cost - responsible for the misdirected water - plus harassment & smoke screens  Lawyers I have asked have either waved it away as easy, or told me 'you can never win against a HOA'   Neither angle has been helpful not explained to me.
