Just put the terms of the financing In the special stipulations section, and have your attorney or title company write up the note.

The stipulation from the sell order states the house be sold at a minimum the assessed value. 

I understand that some sellers, like REO, may stipulate cash being available, but they can not keep you from borrowing as a seller. :)

Your agent should have put in the correct stipulations to protect you from a number of things....including a wacky listing agent.

Of course, if your contract stipulates that the funds are provided earlier than the closing, then the buyer should wire funds based on whatever schedule is laid out in the contract.
