:)I suspect if an owner pitched a fit he would get this scenario over turned and the owner would have to go through the legal motions to foreclose.I know in Oregon if you record a lease option and have a fight the judge with require a full blown Sherriff sales which takes a year..

Keep in mind that the Missouri Supreme Court this past month has decided that tenants have the right to a jury trial in rent and possession. . . so your tenant when you evict could hire an attorney and go to trial, not sure if they have a right to have an attorney provided for them or when the new rules will start being used.If we are unsuccessful in getting this overturned, expect a lot longer time frames - think months, not weeks and much higher costs. . .

They know it is unconstitutional, but they will push it through anyway via executive action, that will then be challenged and overturned in the courts after long litigation periods.

In my humble opinion, once it's been approved, it would take a revolution to overturn it :(I am one of the probably hundreds if not thousands of small investors that got punched in the stomach real hard because of this situation, and I know there are several others out there (still ignorant to the fact) who will, eventually, have many sleepless nights because of this.I was very new and ignorant to real estate rules, laws and regulations when I started.

It can even be used to show that birddogging fees are not illegal, because of the actual wording of the judge.Even though the case law may not have overturned there have been new laws added since then which may make it a moot point.
