@Leah Bonner     Leah,       In Maryland legislation was passed forbidding talking someone into selling their property who is in the foreclosure process.

This legislation, if passed, would become one of the most extreme rent control and regulation bill in the COUNTRY.      

You will also want to engage an attorney that is familiar with owner-finance transactions, so they can draw up the documents and make sure you complying with the Dodd-Frank legislation.

Much of the risk, besides the obvious issues with holding an interest that isn't recorded, is unknown (even unknowable) with the uncertain application of the new legislation and how mortgage originators might adjust internal policies.

I didn't read the actual legislation, simply opinions and summaries of it including one from NAR so as I understand it kickbacks of "anything of value" as defined by the law are prohibited anywhere in the U.S.

Never cease in your desire to learn as this industry is constantly evolving with ever changing legislation.
