Before she can pay you she will of course need to address:– HELOC payments– reconciling HOA dues– ongoing mortgage payments– normal monthly living costs (in SF)– normal insurance expenses (in SF)– ongoing out-of-pocket medical expenses– ongoing CC debt payments (which creep up when unemployed)– beginning her own personal financial recovery and savings needs– taxes, and a possible bump in accountant fees to navigate a challenging financial year– one or two typical building expenses which will not thoughtfully wait to occur for your sake or hers (her share of a new roof/walkway/HVAC repair, or replacing a major appliance, etc)If she can’t pay:– do you have a slower payback contingency plan?

Even if a market dips down again historically real estate goes up and when it does again it goes higher than the last downturn.So they key is if you buy a property where income goes down and with your job you can't pay the mortgage etc. then you might be in trouble hanging on until the recovery happens.A lot of things are due to poor planning.

So maybe your state has a similar association for landlords...I never do more than a month to month lease, never had any issues, people stay and if they want to leave a stupid 1 year or 2 year lease isn't gonna make them stay any longer, and chances of recovery for unpaid rent is not likely, landlords are required to advertise, and rent out a vacant unit as soon as it's vacant, so losses would be not be huge for the tenant, the laws favor the tenant, The best reason for month to month is you are in charge you have more control of if you want them to stay or go, you can guarantee the rent rate for a 12 month period to give them something to rely on for stable price but month to month weeds out the problems and keeps the good ones.

The judgment recovery companies that pay for your filing costs and split 50/50 keeps more money from flowing out of your pocket.If the tenant is judgment proof then the attorney or collection company will still take it and try once or twice and give up.

Pretty soon you have to bring the hammer as no pays are spreading like a cancer.You file tons of eviction notices and all of the sudden everyone pays again.It will cost the tenant much more to move their stuff and put deposits than to pay the rent.Having a temporary problem is one thing when they can get back on track for next month.When they habitually make excuses it's time to cut the cord and let them go.It's like a bad home loan.If the lender can work it out they let them stay but if there is no chance of recovery they let them go.Everyone has life problems they have to deal with no matter who you are.I think you tried to help and hoped for the best.Sometimes people are destined to fail.

I doubt you are entitled to compensation based on your theory of recovery, "complete disregard for our safety and comfort" (a quasi malice standard?)
