Get confirmation in writing as verbal doesn't hold water.Have a stipulation in your contract for the zoning you desire for your use or you can walk from the contract.We used to do this when I worked for commercial developers.

For added protection, stipulate in the ICA that you will hold back a pre-determined percentage (similar to a bond) at the end of the project that would not be payable to the contractor until all municipal final inspections are passed and stickers issued.Hope this helps.
