Hello, hope you are healthy and safe.I'm very aware of section (s.) 212.02(12), Florida Statutes (F.S.) which states ALL money collected from a tenant in a Commercial Property is considered rent and as such it's subjected to Sales Tax (5.5% + 1% Miami-Dade).I have a BIG objection with this statue.

For instance, if all apartments in your market are using granite countertops and vinyl flooring, you don't want to install marble countertops and brand new hardwood floors.

The other parcel has 3.5 acres which has an all brick ranch house built in 1967. it has 3 Baths, 3 Bed. 2 fire places. it was custom built. cedar closets, knotty pine wall, partial finished basement, two fire places (one brick one marble from italy) It also has a HUGE cinder block barn (2 levels) on the property (as it used to be used as farm land a long time ago).

Additionally, the State of Texas has a 2 year statue of limitations, if he wasn't paid, and he wanted to sue me now, he couldn't.

The whole article is suspect when clearly the author doesn't seem to actually understand what a promissory note is and it's presence in all real estate financing and is not a result of a short sale.Moral of the story, there is more to the statue of limitations when it comes to enforcement of promissory notes secured by mortgages and deed of trusts.
