Scott, very generally speaking, the "occasional investor" can sell property using the installment method for tax purposes (reporting gain only when and as the cash is received), whereas a "dealer" must report the entire gain in the year of the sale.Clearly, the dentist who infrequently dabbles in property deals can get installment treatment for his gains, whereas the chap whose sole source of income is his full-time business of doing property deals is a "dealer".

Oh, but let's say that the project is 80% or more owner managed, The Homeowners Association is made up of non-real estate types, maybe a retired teacher, a dentist, an engineer and a Realtor and load the other board memebers with whom ever you like.What you'll get is an engineer that wants strict building requirements and maintenance done, no holds bar on the costs, a teacher who wants only the outside to loom pretty, a Realtor who is geared to re-sale value....the dentist wnat to call in an expert and get a committee to advise the board...you get the idea.
