@Chet Mazur Chet I grew up in Cupertino just FYI Hwy 280 was not built yet and Stevens creek and Hwy 9 ( now De Anza BLVD) were still gravel :)It sounds like with the equity in this deal and the fact Trustor ( assuming CA instrument) is not responsive that a sale may very well happen and you will get paid off .Hopefully you bought the note for less than face value and you will make a tidy profit.Good luck with it.you can hit me off line if you want as well if there is any other things relating to this

Think about this - When a bank offers a home buyer money to purchase a home and the deal goes thru, the bank turns that mortgage document into a copyrighted instrument as a derivative which they sell multiple times.

You can advise her to get a real estate attorney etc, but as far as you getting involved it could look bad in court (You turn out to be an instrument of her attempts for self eviction..... her hired bully)2) Having the property condemened can cause more problems than you want.

Sounds good, until I read this in CI'S Terms of Use, under the section labeled Use and Restrictions Related to the Services "You should not use the Services to execute any documents or instruments, or to make any offers or proposals that you intend to be legally binding.

Here is the exact language from the statute: "(b) Every provision in a written instrument entered into relating to real property which purports to forbid or restrict the conveyance, encumbrance, leasing, or mortgaging of the real property for use or occupancy as a family day care home for children, is void and every restriction or prohibition in any such written instrument as to the use or occupancy of the property as a family day care home for children is void."

Remember, the Mortgage is the security instrument that places the house up as collateral, executed by the owners of the collateral...it is not the loan/debt instrument(the Note).
