I am not in this transaction but sounds like gross negligence on the part of the agent giving advice which had adverse consequences.Time to call the main brokerage who has the listing and tell the qualifying broker the seller will sue if the broker doesn't immediately pay damages.Short sale or no short sale the damage is almost the same anyways.Could just do a DIL if no other liens are present to the bank.No legal advice.

The fact is that when you're leveraged at 100% on a property, your debt coverage ratios are moving down rapidly, such that non-periodic adverse events with the property can cause you to be digging deep into your pocket to stay afloat.

All you can do is repair the existing billboard (even if an earthquake knocks it down you are not allowed to put it back, Welcome to CA lol).The reason this adverse clause for the owners of the building is in there is to protect the Billboard company from losing their investment to another company after a couple of years.

@Mark Douglas if the rejection was based on a credit report then you should send an adverse action letter to the applicant for those situations.
