Depending on how far values decline is the difference between a partial loss and total loss. in essence its the same position of those who make second loans behind the first or third position when pref goes in front of you..

The other positive, at least for apartments.com is if they fill out an application it's good for any other unit on the site for 30 days without having to pay the fee again.Not that it matters for the law but another thing we do for tenants after they are selected is do a gift basket that exceeds that in which they paid in application fees.

And I still coach, and people still lend me money on my deals, but I thought there would be a market for people that wanted more of an equity position by doing this model rather than just the debt position by getting a 10 to 12% return in second position.
