@Russell Brazil Hey correct me if I'm wrong but the listing agreement language isn't even relevant here.The relevant contract for payment of commissions is the employment or IC agreement between the broker and agent... and I'd be willing to bet anything that contract says you get paid only if the broker gets paid.

Have the terms written in your purchase agreement in simple words you and your seller can understand and then title/Escrow will write up the Note/deed in legal language and you both sign off on it.

I have been doing a lot of back of the envelope calculations using 1% of the financed amount vice 1% of purchase price and that seems to be the go no-go point for positive cash-flow for a lot of deals these days.From what I've seen, and my investigation is just in it's invancy, rental rates seem to drop off qucikly as you move away from the university (like outside 1 mile).

Lender is stating this is standard language (purchased standard form etc.LaserPro, Ver. 20.2.20.003)Basically sign away the enclosed rights or we do not furnish the loan.Waives include:- right to a jury- confession of judgement (two different times (one personal, one LLC)- guarantor waiversThere is no comfort in a standard purchased form when the standard form requires waiving rights.Not expecting problems meeting obligations of the loan, and yet does not seem right to waive rights to get the loan.
