It is also highly likely that when the seller originally took out the mortgage on the property, he signed some sort of errors and omissions waiver that encompasses situations such as this where something has been mis-filed or recorded incorrectly.One other thought, I don't believe there would be anything stopping the lender from recording the property today/next week/sometime in the future, especially since they are now aware of the situation.Obviously, I'm not a lawyer, so please don't take the above as legal advice.It sucks that this happened to you, but definitely better to find out now than after you have already bought the property.

It's essentially applying a layer (or layers) of drywall "mud" to the entire ceiling, thick enough to encompass the popcorn/texturing and smoothing (floating) it out.
