If he's financially tight, as some have suggested he probably is, he might just sign and walk away with the check in lieu of a dragged out battle he surely doesn't want.I would definitely have an attorney manage the exchange.

Every month we call and it's one excuse after another.So tomorrow we will serve our first 3-day notices to both units, and likely will have to fight the eviction battle... both units have families (children).

I would have these internal battles in my mind, everyday before making calls and I would have to psych myself up to have enough guts to even lift the receiver to make calls; most often, these internal battles were something I had to over come every minute.

You are entitled to one unit with the current zoning, and I would suggest going that route of just building oneIf you want to fight the uphill battle, I would suggest hiring an attorney to assist you in the rezone, speak to your councilman (they will want it changed to R6-A which will drastically change your site plan), door knock the neighborhood and get them to sign a document that they are in support of the rezone, etc.
