You'll need a lawyer to generate the paperwork and filings and experienced enough to give you general advice on the process, help you establish appropriate compliance and back office procedures.

This question has always eluded myself, the loan officers I speak to, and my accountant. 

Getting the official legal advice in writing from an attorney rather than a CPA, since they are officers of the law, can give you greater protection than just advice from a CPA. 

If this isn't the first time, I'd give them notice regardless if the police were called before or not. 

I filed eviction and got writ possession but sheriff office is saying the next available date is in September.

Make sure that your lender/loan officer is willing to get on a call with your lawyer to help out with any discussion/details to dial the agreement in as much as possible.
