If you “informally” attempt to  get him out on your own somehow, the situation is ripe for a wrongful eviction countersuit, and then he could get a six figure settlement.

did you use  any creative financing, delayed  settlement, seller take back, subject to, wraps, banking days, possession before settlement, seller refi for take over, hybrid offer or public auction disclosure?

My wife is an expert on mortgages, and she sent back the Statement of Settlement Cost back to them about 7 times before they got it right.

I got a 25k insurance settlement which paid for a 30 year roof and a privacy fence covering almost half an acre. 

Its my impression that the federal government, local governments and large corporations have done very little to help mitigate these problems, despite government and class action attorneys taking large monetary settlements from offending corporations.

If I were in your shoes I would try to negotiate cash for keys and see if you can reach a settlement.

But in most scenarios, the best that a foreclosure defense attorney can do for most residential defendants is to delay the inevitable and try to negotiate out a settlement.
