You cannot lease a property that has a mortgage on it because the mortgage has what's called an assignment of rents attached to it...You're treading on very gray area with the law.A title company will not insure a property that has an installment land contract because, technically they are illegal (by splitting hairs).

Ok so I was trying to find out about how to refinance out of a hard money loan while keeping my property in my business name I have a great flip and good hold property in Atlanta and it's time to sell and or refinance the property but I have been running into a gray area on where to go to refinance through my business name and who might be a good choice if I have to put it in my name for a short time ????

If you are really concerned you can call the real estate agency and talk to them before you move forward but from my understanding you will be covered if you have a contractor's license - its those of us without the contractor's license that fall into a gray area.
