John,Sorry I was mis understood HML did not turn down a deal or have I even mentioned a deal to them I went with HML on my last 3 houses i did and its time to refinance them in my name but like i originally said my credit is limited income/debt ratio especially because I've racked up expenses starting my business and haven't shown much income on the books since i started the business.

If you rack up $50K in passive losses between now and then you would get a very serious deduction in the year of the sale.There can also be a bit of 'tax arbitrage' at play because the maximum rate on the "depreciation recapture" is 25%.
