In my personal opinion, 24 months is a very conservative hold time because it straddles three tax years and if audited, you can clearly show your intent to hold.

Even if they do, you can negotiate to buy the debt as assignee and probably make as much or more money as you would as a rehabber (without all the work).You can control the deal from both ends (which I call a straddle play).

However, if you took one property and after fixing it up you decided to hold it and emailed your CPA that you decided to hold it as a rental and then you did actually rent it out for a period of time - say 24 months, which would straddle three (3) tax returns - and then sold and exchanged - you would be able to demonstrate that you did in fact have the intent to hold.

I often see parcel lines that don't line up perfectly with buildings, but in some cases, such as this one, I think the house may truly be straddling more than one parcel.The idea that the owner of this house has adversely possessed it is fascinating - I never would have thought of that.
