If you are able to get grandfathered into the status of remaining as a rental, then all the power to you- but like you are experiencing, the HOA may not want to deal with the influx of tenants and costs associated with every time someone new moves in and possibly damages the elevator, hallways, etc.

I assume that would be in the case where the unit has a lead issue, a child has elevated lead in their blood, and the landlord can't afford the remediation (right away).
