I believe the small town has great potential but have been warned a million times to stay away from buying here as lot of friends of friends had to short sale or foreclose when the market came down.

Seems to have some opportunities, but I've been warned of certain areas.

After many attempts to go to the HOA and property management company, they say there is nothing they can do, they have tried warning him, etc (The HOA rules and regs mention fines for noise disturbances, but I don't know if they have implemented that).

If you don't have a fine amount, have your attorney write up some type of formal letter warning them they are in violation of the lease and if caught again you will look to terminate or seek damages (or whatever your attorney thinks is best based upon how your lease was originally drawn up).
