I have lived through something similar and trust me you want everything spelled out in writing once you make the verbal agreement.  

If you have an open escrow, just spell out who gets what under what conditions.Draw a pictograms and make it simple for others to understand. 

This is spelled out in the MLS.

Our OA has a Management section specifically spelling out the duties, rights and powers, obligations, who can sign, etc.Hope this helps....

Sounds like your contract should spell this out?

Have an assignment agreement signed between you and the bird dog that spells out the details.

For example, placing “The (Team Name) Team” at the top of the page in large letters with a much smaller brokerage symbol somewhere below is not sufficient.The employing broker’s name must be spelled out in its entirety.

Unless the person is a sole propritor ( cant spell tonite) They may be using the same account for their business .
