Not because it doesn't have merit but because it's been the same number since 1980 and $1M was worth a lot more back then than it is now. 

If a commercial deal stands on its own merit and the lender ends up with it, it eats less hay while in the portfolio and is easier to get rid of.

I was thinking that it could be fairly common to have a mixed crowd of extended family, like 2 couples, some kids, and 1-2 singles or young adults.Wondering if there is merit to 2 king rooms, a bunk room for kids, and an all-purpose 2 doubles room (plus a queen pull-out couch in the living area).

I have seen it on 2-3 units as well where they close off a top story or below and have it still listed as 2-3 units without giving merit to the conversion due to lack of additional meter.

So instead of defending based on legal merit, the attorney is directing their actions to fabricate a defense strategy. 

They sued to challenge the rules, and to seek being grandfathered if the challenge failed on the merits, and lost on both accounts!
