That original third then becomes the second position lien.All of the above presumes that there was no subordination agreement between the various lenders involved; if there were to be subordination(s) in place, then the subordination agreement should stipulate which lien positions are changing priority / position.

I was thinking about having the seller and her business partner (i.e. the person listed as the tenant on the rental agreement) sign some sort of stipulation that there is no valid rental agreement in place and they have no right to the property after close of escrow.

Yes, you should have a purchase contract with you and the disclosures should be your standard state disclosures along with any disclosures your RE attorney stipulates for your protection.

I look at the zoning map and the lots for these properties will stipulate that they are classified as "single-family residences" *6-8 units per acre.
