If it's six inches wide or more, can't stuff newspapers in and patch, you need to cut the hole larger, a square hole, insert a small piece of sheetrock the same size, with a 1 by 2 behind it to secure it, then spackle.

You can insert a forum choice clause, but courts don't always follow it, but it can help.
