Not a lawyer, but I believe the plan of getting "owner occupied" financing for a building, and then not inhabiting that building is what is mortgage fraud.I am doing a similar situation and I have not found anything set in stone that says 'one year minimum' but it sounds like that time frame is generally accepted.I found talking to my banker about these things extremely beneficial.

If you were making a claim for the fire anyway, then you were already headed down that path, just make sure the insurance adjuster agrees that the home is temp. not inhabitable due to the lack of air conditioning so that you do get the loss of rents, and extra expenses.
