Your post is confusing because an HOA cannot make a modification to a common element and then charge 1 owner for that *UNLESS* that owner or their tenants damaged the property to begin with.

If contractor is saying this was slow long term extensive damage then it may not be covered by insurance.

Replacing water heater is cheap but if you owned condo in upper stair and water heater is leaking, your damage cost can be substantial because it may flood all the way down the unit on the first floor.

You are tenanted and hopefully cash flowing, and it probably wouldn't serve you to sell it with an active leak or ceiling damage.

Unfortunately, There was a lot of water damage, and I relocated the tenant to a hotel.

Damaged energy markets and a swelled stock market as well as an interest rate past ready to increase.

The rest goes to the tenant, unless something else is damaged.
