As far as if he can sell you the right to the title before he even owns it/fully transfers, those are all gray areas I'm not too sure about.

It's good to be above board but there truly is a gray area if you acquire a property where it's already there. 

With the tenant already living there, the landlord can claim that the work is necessary to keep the tenant satisfied.For those things that could fall in a gray area between improvements and repairs, it really depends on how comfortable you and your accountant are with defending your claim against IRS scrutiny.
