Unless you are negligent, this is not something that you can predict or control..... its out of your control when an appliance malfunctions and there are damages.

Additionally, it ALSO has a clause that says, in part: "Tenant shall immediately notify Landlord, in writing, of any problem, malfunction or damage.

In all of my rentals I use nest thermostats, and in 2 cases I have installed them and they started to malfunction.

Second time it was a tub stopper malfunction and the water back up eventually leaked into the ceiling.

So long as the payment goes through, if payment is made prior to the date rent becomes late, it is considered "on time" regardless of when you get it in your account.If there is a malfunction in the system, tenant is not responsible (see 15 USC Sec. 1693j).

Normally it is the responsibility of the tenant to report malfunctions or needed repairs to the landlord/property manager in a timely manner.

Tenant agrees to allow Landlord timely access to premises to do maintenance and repair.Tenant will notify Landlord in a timely manner of any damages or problems as they arise, including damages caused by Tenant, malfunction of appliances or fixtures, and water/moisture leaks and spots.Tenant will take care of the premises, keeping them clean and clear of debris.
